Branch.
This business is carried out
primarily over the internet, and is regulated by the Distance
Selling Regulations of the Sale of Goods Act under English Law.

Please read the following
terms and conditions before placing an order. They tell you your
rights as a customer, and also cover use of the website. Once the
order has been confirmed, there is a contract between us; and that
contract will be governed by English law.

By placing an
order you signal your agreement to these terms, and any others
displayed on my website or internet auctions, or at events.
You also indicate that you are over 18 and authorised to use
whatever payment method you choose.

Payments:
If you order using the payment buttons on the website, you
will pay the full price of the whip at the time of the order.
If you do not wish to do this, please feel free to email me. I
will be happy to accept a 50% deposit to confirm the order,
with the balance due when the whip is ready to send out. Once
I have received your deposit, I will send you order
confirmation with an estimated lead-in time. Your order will
be penciled in to the order list once you have made it clear
that you intend to order it, but I will not start cutting
the leather for it until the deposit has been received. If
I do not receive the deposit within two or three weeks, and
get no response to attempts to contact you, I will assume the
order cancelled. I will contact you again, for the
balance, when I am in the final stages of making the whip.
Regardless of the way in which you
pay, I will send you
confirmation of your order by email (or post at your request), with a link to these
terms and conditions.

Delivery
times: If you order a
whip that is in stock I will
endeavour to despatch it within a week of your
payment clearing and, in any case, within 30 days. If I am
unable to do so, I will keep you informed of developments and refund your payment in
full at your request. My delivery aim on whips
made to order is 10 weeks or less but, at busy times, it can
rise. To avoid disappointment, if you need a
whip by a specific date, please email me for lead-in times. Whips
from overseas whip makers typically take around 8 weeks to arrive
at your door. Please note that all lead-in times given are
estimates. My health prevents me from guaranteeing
specific delivery dates, unless you are ordering a whip that I
have in stock ready to send out.

Cancellations
and Refunds: Payments and deposits, for whips that are
part of my normal range, will be refunded in full if you
cancel your order (up to 7 days after delivery), or if
I supply faulty goods (under the terms of my guarantee,
below). Refunds will usually be made using the payment method
you used in the first place (for example, via Paypal). As
long as you contact me within 14 days of receipt, I
will be happy to refund your payment or make a different whip to the same value if
you decide that the one you have chosen is not the one for
you, as long as the first whip is returned in 'as new'
condition. To be fair to other customers, for delivery times,
this will be treated as if it is a new order. Exception: If a whip is
custom-made for you, finished to the specification you
supplied, and I believe that it's so unusual that it would be
unlikely to be of interest to another customer, I
reserve the right to not to accept the return of that whip, or to offer a
partial refund that reflects my costs and time in making it.
Other returns
and payment policies may apply to online auctions, or goods
sold face to face.

I am a
designer-maker, constantly working to improve my products.
Please note that no two whips are identical, and that the whip
you receive might have slight design differences from those
shown as samples on the website. The range changes from time
to time as my designs improve and, although I try to keep the
site up to date, I do not guarantee that any particular
design listed on the website is available at any one time. I
will refund your payment immediately if you order a whip that
is no longer available. Exception: whips
listed on the 'Whips
for Sale' page are finished items, ready to despatch. You
will receive the whip shown in the photos next to the
description. These whips are sold on a first-come,
first-served basis, and I try to update the website as soon as
one is sold. If you do send payment for one that has just
sold, I will refund that payment in full as soon as I am able.

12 Month
Guarantee: If I ever
supply you with a whip that is faulty then, in agreement with
you, I will repair or replace the whip or refund you, as long
as the whip is returned within 12 months of the date of
purchase. Outside of that time, if I agree that there's a
fault, I will repair it or replace the whip at my discretion. This
guarantee excludes: damage or loss
of performance through natural aging and use; wear and tear; abuse;
problems arising from incorrect use and technique; or other factors that cannot
reasonably be avoided in the design of a whip. Whip falls can
break at any time, but I will replace yours free of charge if
it does so within the first month of use. Crackers can fall
off at any time and, other than braided-in crackers on signal
whips, I will not replace these when they fly off or break. I
will replace braided-in signal whip crackers free of charge,
if they become too short within the first year of use (damage
through abuse excepted).

Whips can be
dangerous, and can cause disabling injuries. Poor training
practices can also lead to sports injuries such as tendon
damage. The information and advice provided in some parts of
this site, or in correspondence, is offered in good faith, in the belief that it
represents current thinking about good practice with regard to
limiting risk. It is your responsibility to develop your own
safe practices, and you accept all liability for any loss or
damage to persons or property, arising in any way whatsoever
from the use of goods supplied by me, or from acting upon
information available on my site or provided by me. You agree
that, in any case, the limit of my liability to you shall be
restricted to the refund value of any item purchased by you
from me, and that this shall be nil if the equipment you were
using at the time of any incident giving rise to liability was
not supplied by me.

Privacy
and Discretion.
All goods are sent out in plain packaging. My trading name is never
displayed on the packet, nor is any reference made to the
nature of the contents. Exception: When sending goods
to certain countries, I am required to complete Customs
documentation that briefly describes the goods being sent. If
I need to contact you about your order, I will attempt to do
so by email first. I do not maintain a database of customer
details; and will not add you to a mailing list or send
unsolicited promotional emails after our business is
concluded. When you visit my website, I gather no information
about you via cookies or other software, other than anonymous
information provided by my hit counter. Your personal details are never passed on to other
businesses.

No content
from this site may be reproduced elsewhere. Selling whips
is how I make my living. I will take action to protect that
income against any person,
website or business that uses my images, text, logo or trading
name in any way. I will pursue you in court if I believe that
you have profited financially, or have damaged my business from
use of my material or designs, either from this website, or
published on any other website or in any other media. It isn't
very nice to have to do it, but neither is stealing work that
has taken hours, days or even weeks to put together. You have
been warned!
